We acted as legal counsel for the owner of a container terminal in the Port of Rotterdam in an arbitration about defects in a so-called "combination surface layer". This is porous asphalt filled with concrete. A combi surface layer is a type of asphalt surface layer in which the characteristics of these two materials are combined: the flexible and seamless nature of asphalt and the strength of cement concrete. Because of the defects, the ISO containers were sinking in the combination surface layer. The arbitral tribunal ruled in favor of the owner and ruled that the contractor was liable for the damage.
